Gambia dismisses Western criticism of anti-gay law

The Gambian government has lashed out at Western donor nations that have criticized a new law that punishes some homosexual acts with life in prison, report AP.

The European Union and the United States recently expressed dismay at the law and discrimination against gay people in the West African country.

Both provide aid to impoverished Gambia and have used that position to encourage respect for human rights.

The Gambian government will not allow acceptance of gay people to be a pre-condition for receiving aid "no matter how much aid is involved," Foreign Minister Bala Garba Jahumpa said in a nationally televised addressed late Saturday.

"We are no longer going to entertain any dialogue on the issue with the European Union or any other foreign power," he said.

The new law, which went into effect Oct. 9, criminalizes "aggravated homosexuality," which targets "serial offenders" and people living with HIV or AIDS.

Suspects can also be charged with aggravated homosexuality for engaging in homosexual acts with someone who is under 18, disabled or who has been drugged.

The term also applies when the suspect is the parent or guardian of the other person or is "in authority over" him or her.

The law contains language identical to an anti-gay bill signed into law in Uganda this year that was later overturned by a court.

People found guilty of aggravated homosexuality in Gambia can be sentenced to life in prison.

The UN has pledged its “full support” to Nigeria to end terrorism following the attack on Kano Central Mosque on Friday, which left many worshippers dead and several others injured.

This is contained in a statement issued by the UN Secretary-General Ban ki-moon and made available to the News Agency of Nigeria (NAN) in Abuja.

While condemning the act, Ban said that there was no justification whatsoever for the attacks on civilians.

Ki-Moon “reaffirms the full support of the UN to Nigeria’s efforts to fight terrorism and to provide security to the population consistent with international law and Nigeria’s human rights obligations.”.

He conveyed his “deepest condolences to the families of the deceased and to the people and Government of Nigeria” and wished swift recovery to the injured.

The Secretary-General called on the relevant authorities to swiftly bring the perpetrators to justice.

German pilots' union calls Lufthansa strike for December 1 and 2

German pilots' union VC is calling a strike at carrier Deutsche Lufthansa for Monday and Tuesday after talks broke down over retirement benefits.

The dispute, over proposed changes to an early retirement scheme for pilots that was developed decades ago, has resulted in repeated strikes this year, affecting thousands of passengers of Germany's largest airline.

The VC union said the Germany-wide strike would last from midday (1100 GMT) on Monday to 2359 CET (2259 GMT) on Tuesday for short- and medium-haul flights, as well as from 0300 CET (0200 GMT) to 2359 CET on Tuesday for long-haul flights.

Pilots flying for Lufthansa Cargo will also strike from 0300 CET to 2359 CET on Tuesday. Flights of budget arm Germanwings are not affected.

Lufthansa said the strike was completely disproportionate and called for an immediate resumption of talks.

It said it made concessions in recent talks, including a 5 percent pay rise, but reiterated that it would not accept a demand that new pilots, as well as those already with the company, should be able to retire at 55.

Eight walkouts by staff this year wiped 160 million euros ($200 million) off the carrier's operating profit, adding to pressure from a stuttering global economy and increased competition.

Lufthansa, which last month lowered its profit guidance for 2015 for the second time this year, is expanding low-cost operations to better compete with budget carriers and Gulf rivals and to outflank the pilots' union.

Lufthansa plans to use other pilots from within the group who are not on expensive collective labor agreements to staff tourist routes, where the brand, which usually focuses on business travelers, is trying to reduce costs.

Passenger transport in Germany has also been disrupted by train drivers' strikes this year. The latest walkout earlier this month thwarted many Germans' plans to travel by rail to celebrations marking the 25th anniversary of the Berlin Wall's fall.

Like the pilots, train drivers have yet to reach a deal with their employers.

Alleged N164bn Debt: Access Bank Obtains Order To Sell Erastus Akingbola’s properties in London, Cayman Island


A Grant Court of the Cayman Islands has granted Access Bank Pls leave to sell more of the properties belonging to former Managing Director of the defunct Intercontinental Bank Plc, Dr Erastus Akingbola recently discovered on the Island.

The court also asked Akingbola to pay Access Bank  the sum of N238,471,484,162 and  £1,800,000 with interest at 2. 5/8% per annum from April 2014 until payment.

It will be recalled that a London High Court in July 2012 had also asked the embattled former bank chief to pay Access Bank the sum of N164 billion while delivering judgment in a recovery action filed by the then Intercontinental Bank in order to recover the Bank’s funds he allegedly fraudulently converted and misappropriated.

Access Bank had acquired Intercontinental Bank on January 31, 2012 after the bank was taken over by the Asset Management Corporation of Nigeria (AMCON).

During the course of the trial, some of the funds were traced to the purchase of properties in London by Dr. Akingbola consequent upon which the Court ordered that the properties be sold.

Based on the Court Orders, the following properties were sold and the sums of £11 million Pounds have so far been recovered. Properties known as Flats 17, 18, 19 and 20 Embassy Court London, NW 8 were sold.

Upon the discoveries by Access Bank that Dr. Akingbola has some assets hidden under a Trust in Cayman Island (specifically property known as 2 Cambridge Court), the Bank proceeded to file an application to the Grant Court of the Cayman Islands to convert the London Judgment to a Cayman Island Judgment.

This was done after Akingbola allegedly refused to challenge the application.

The Grand Court of the Cayman Island on the 12th September 2014, granted judgment in the sum of N238,471,484,162 and  £1,800,000 in favour of the Bank with interest at 2. 5/8% per annum from April 2014 until payment.

But two weeks ago, Justice Chukwujeku Aneke of the Federal High Court in Lagos had told Access Bank Plc that the £654 million (N212.2 billion) judgment its obtained against Akingbola from the London Court is not enforceable in Nigeria.

Justice Aneke, who stated this while ruling on an application filed by Access Bank to enforced the London judgment in the country, held that Justice Burton's admission of hear- say evidence in reaching the judgment ran counter to Nigerian law and practice which placed premium on cross examination of witness by counsels. 

In addition Justice Aneke explained that by denying Akingbola the right to appeal the judgment amounted to a breach of his fundamental right which no Nigerian court could do.

Quoting several Supreme Court cases he stated that the right of appeal was every Nigerian's inalienable right adding that the London court contravened this fundamental provision of the constitution.

Dutch authorities have reported a fresh outbreak of bird flu on a poultry farm in the west of the country, but could not say if it was the worrying new strain detected elsewhere in the Netherlands.

“Avian influenza has been detected on a poultry farm at Zoeterwoude,
where some 28,000 birds are affected,” the economy ministry said in a
statement on Sunday.

“The birds are infected with the H5 variant of the flu but it’s not yet known whether of the highly pathogenic variety or not,” it added.

The highly infectious H5N8 strain of bird flu was discovered in the
Netherlands two weeks ago, where authorities suspect it might have been brought in by birds migrating from Asia.

Some strains of bird flu are fatal for chickens and pose a health threat to humans, who can fall sick after handling infected poultry.

Dutch authorities have said human infection can only occur following
“intense and direct contact” with infected birds.

The H5N1 strain of bird flu has killed more than 400 people, mainly in south-east Asia, since first appearing in 2003. Another strain of bird flu, H7N9, has claimed more than 170 lives since emerging in 2013.

The latest outbreak came in a poultry farm about 21 miles (35km)
northwest of Hekendorp, where the first outbreak was detected in mid-
November, leading to around 150,000 birds being destroyed.

Bird flu has been detected in at least three other locations in the
Netherlands and Germany, and Britain has also reported similar strains of the virus.

Authorities on Sunday were destroying the birds at the site of the latest outbreak at Zoeterwoude and have set up a six-mile (10km cordon around the farm.

Four other poultry farms in the area are being investigated for bird flu,
authorities said.

The H7N7 strain of bird flu severely hit the Netherlands in 2003 with health authorities destroying about 30m birds in an effort to limit the outbreak, reports The Guardian.

There are 95m chickens on Dutch poultry farms and egg exports totalled €10.6bn (£8.4bn) in 2011, according to the latest Dutch statistics.

The death toll from the worst Ebola outbreak on record has reached nearly 7,000 in West Africa, the World Health Organisation said on Saturday.

The toll of 6,928 dead showed a leap of just over 1,200 since the WHO released its previous report on Wednesday, according to a Reuters news agency report.

The UN health agency did not provide any explanation for the abrupt increase, but the figures, published on its website, appeared to include previously unreported deaths.

A WHO spokesperson was not immediately available for comment.
Just over 16,000 people have been diagnosed with Ebola since the outbreak was confirmed in the forests of remote southeastern Guinea in March, according to the WHO data that covered the three hardest-hit countries.

Guinea, Sierra Leone and Liberia have accounted for all but 15 of the deaths in the outbreak, which has touched five other countries, according to the previous WHO figures.

In a separate development, Sierra Leone will soon see a dramatic increase in desperately-needed treatment beds, but it’s not clear who will staff them, a top UN official in the fight against the disease has said.

Sierra Leone is now bearing the brunt of the 8-month-old outbreak. In the other hard-hit countries, Liberia and Guinea, WHO says infection rates are stabilising or declining, but in Sierra Leone, they’re soaring.

The country has been reporting around 400 to 500 new cases each week for several weeks.

Those cases are concentrated in the capital, Freetown, its surrounding areas and the northern Port Loko district, which together account for about 65 percent of the country’s new infections, Anthony Banbury, head of the UN Mission for Ebola Emergency Response, said in an interview with the Associated Press news agency.

According to one pregnant mother, Mrs. Amarachi Ogbonna, garden egg leaves are very for pregnant women. “I use it in cooking and also squeeze the juice to drink wish serves as blood tonic. Back home, they eat the leave raw, in African Salad or mixed with red oil.”

Also responding, Mrs. Lara Benjamin said “I use garden egg leaves when my children are anaemic as a natural blood tonic. I squeeze the juice from the leaves and mix it with a malt drink.”

“It works faster than folic acid in improving blood level especially since my children don’t like taking drugs,” she said.

“The last time I went for antennal, my blood per cent was 39 while other women were having 31 and 32. They were asking me what I usually eat, and then I told them about to eat anara leaves,” she said.

Dr Bright Chimezie Anwacha of the University Uyo Teaching Hospital explained that the leaf provides women with micro nutrients which help in improving blood level.

“For the baby, it provides it with basic mineral elements for proper development and also prevents inborn errors of metabolism, defects and improves the baby’s weight. This is because anara is rich in mineral elements especially folic acid which is necessary for red cell formation,” Dr Anwacha explained.

Experts are encouraging people suffering from elevated cholesterol level and obesity to eat more of this vegetable in its fresh form. Garden egg consumption is also beneficial for people that are suffering from constipation because of it high fiber content. Take garden egg leaves today and enjoy all its health benefits.

The House of Assembly primaries of the Peoples Democratic Party in Ogun
State was yesterday mired in controversy as rival groups continued to battle
over the control of the party’s structure, delegates and candidates.


While the party’s state executive committee loyal to a PDP chieftain, Prince
Buruji Kashamu, conducted the primaries, loyalists of former Governor
Gbenga Daniel and former House of Representatives Speaker, Dimeji
Bankole, boycotted the primaries, citing the directive of the party’s National
Working Committee.


There had been confusion Friday night over which delegates list to be used
for the primaries across the 26 state constituencies of the state. The
chairman of the PDP Electoral Panel for House of Assembly, Akeem
Animasaun, had told journalists that the primaries were postponed due to
the nonavailability of the delegates list and documents.


But at some of the designated centres in the local governments, the
exercise was conducted by the state party executive. Speaking with
reporters in Abeokuta yesterday, the state PDP Chairman, Chief Adebayo
Dayo, said the primaries were valid and peaceful across the state. Dayo
claimed that the state executive had the backing of the national leadership
of the party in going ahead to conduct the exercise.


“The members of the committee sent from Abuja were five; they cannot
cover the whole 20 local government areas. They will come to the party
secretariat to collate the results,” he stated. However, concerned elders of
the party in the state dissociated themselves from the state House of
Assembly primaries conducted by the Dayo-led executive. In a statement
signed on behalf of the concerned elders by a former House of
Representatives member, Dave Salako, and made available to reporters in
Abeokuta, they said the exercise was in defiance to the position of the PDP
National Secretariat in Abuja.


According to Salako, the primaries were being put on hold till another day to
enable the national leadership to address certain issues raised by party
stakeholders concerning the primaries. The PDP chieftain, who belongs to
the Bankole group fingered Kashamu and two members of the PDP NWC in
what he described as “illegal exercise in Ogun State.”


He said, “For the avoidance of doubt, no state chapter of the party has the
power to unilaterally conduct any congress or party’s primaries on its own.


Only the National Secretariat of the party has the power under the
constitution of the party and the guidelines for the primaries, it is the sole
duty of the National Secretariat of the party to send down its officials and
the materials to any state for such an exercise.


“In line with the guidelines of party, we were fully prepared for the primaries
earlier slated for today (yesterday) before we received news from Abuja
that the exercise has been put on hold. Based on this development, we
have to stand down and brief our members accordingly. That is where we
stand only for us to wake up today and be hearing another story that the
primaries is holding.


“The questions we are now asking are: who are the members of the
committee from the National Secretariat in charge of the exercise? Where
did they get the materials purportedly used for the exercise? At what time
did the National Secretariat directed that the exercise should hold?” Salako,
therefore, called on the party’s national leadership to sanction those
allegedly behind the “illegal exercise.”


“The wearisome aspect of it is that the National Auditor of the party, Alhaji
Adewole Adeyanju who should know better, was busy going round the state
blackmailing the National Chairman, Alhaji Adamu Mu’azu and boasting that
he would go to court on Monday to legitimise the kangaroo primaries; this
is rubbish,” he added.

Autonomy: Judiciary Workers Suspend Strike, As FG Agrees To Implement Court Ruling

Following an agreement reached between the federal government and the Judiciary Staff Union of Nigeria (JUSUN), the accountant general of the federation (AGF) is to commence the implementation of the federal high court judgment during the next Federation Account Allocation Committee (FAAC) meeting which is holding in two weeks.

It may be recalled that JUSUN got a court order from the Federal High Court Abuja on January 13, 2014 regarding respect for the constitution of the Federal Republic of Nigeria on financial autonomy of the judiciary.

However, in a memorandum of understanding (MOU) reached at the end of a marathon meeting at the instance of supervising minister of Labour and Productivity, Kabiru Turaki, the leadership of JUSUN and other stakeholders, it was concluded that the AGF is to make deductions during the next FAAC meeting to the National Judicial Council (NJC) in line with the court judgment.

The MoU also stated that the deductions will be done based on the actual funds released that can be defended by the respective States and concurred by JUSUN.

The MoU, which was jointly signed by the permanent secretary ministry of Labour, Clement Illoh, the accountant general of the federation, Jonah Otunla, JUSUN president Marwan Mustapha Adamu, director, Home Finance, Federal Ministry of Finance, K. Zaji, and others, said in view of the above, JUSUN suspends the threat to resume strike Monday, December 1, 2014.

The MOU reads in part: “The issue of concern to the members of JUSUN remains the implementation of the subsisting judgment of the Federal High Court delivered on January 13, 2014 regarding sections 81(3), 121(3) and 162(9) of the 1999 constitution of the Federal Republic of Nigeria as amended.

“On November 27, 2014, as a follow up, a meeting was called in the instance of supervising minister of Labour with JUSUN among other stakeholders to discuss the outcome of the last meeting held on November 19, 2014, in that regard”. The meeting noted that the assignment given to the director, Home Finance, had been executed.

“The figures submitted by JUSUN had been reconciled with the budgeted estimates by the states accountants general. Based on the above, it was concluded that the AGF will make deductions during the next FAAC meeting to the NJC in line with the court judgment based on the actual funds released that can be defended by the respective states and concurred by JUSUN”.

GlaxoSmithKline has announced an initial success on phase 1 trial of
an Ebola vaccine.

The first results from the trial published on Thursday in the New
England Journal of Medicine showed that a GSK and National Institute
of Health Ebola candidate vaccine was well-tolerated and produced an
immunological response in each of the 20 healthy adult volunteers in
the United States who received it.

In a statement released on Thursday by the pharmaceutical company,
the vaccine used in the trial conducted by the NIH was co-developed
by the institute’s National Institute of Allergy and Infectious Diseases
and Okairos, a biotechnology company acquired by GSK in 2013.

The statement read in part, “It uses a type of chimpanzee cold virus,
known as chimpanzee adenovirus type 3 (ChAd3), as a carrier to
deliver genetic material from two strains of the Ebola virus – the
Sudan strain and the Zaire strain, which is responsible for the current
Ebola outbreak in West Africa.

“GSK has been working with the NIH to accelerate development of
both this bivalent version of the candidate vaccine and a monovalent
version targeting only the Zaire strain in response to the current Ebola
epidemic.”

Commenting on the results, Chairman of Global Vaccines at GSK, Dr.
Moncef Slaoui, said, “We are very encouraged by these positive first
trial results showing this type of vaccine has an acceptable safety
profile and can produce an immune response against Ebola in humans.

Working with partners including the NIH, we’re doing all we can to
advance development of a candidate vaccine in response to the Ebola
crisis in West Africa.

“It’s important to remember that these data are the first piece in the
jigsaw and we’re continuing to gather other important information.
Over the coming weeks, we will see results from further phase 1 trials
which will tell us more about the profile of the monovalent vaccine;
most significantly results from a trial in Mali which is assessing its
safety and immune response in West African populations.

“If the combined data from these trials are positive, the next phases
of the clinical trial programme will begin in early 2015 to see whether
the immune response we are seeing in phase 1 actually translates into
providing people in affected countries with meaningful protection
against Ebola.”

Slaoui added that the phase 3 trials would involve the vaccination of
thousands of volunteers, including frontline health-care workers in
affected countries, including Liberia and Sierra Leone, and possibly
Guinea.

“If the candidate vaccine is able to protect these healthcare workers
as we hope it will, it could significantly contribute to efforts to bring
this epidemic under control,” he noted.

Former Minister of Foreign Affairs, Olugbenga Ashiru died today November 29th in a South African hospital after a long battle with brain tumor. He was 66 years old.

The career diplomat served as Nigerian Minister from 2011 until 2013. He was also Nigeria's High Commissioner to South Africa.

Fifty nine passengers and four crew members escaped death by the whiskers on Saturday when an Overland plane from Abuja overshot the runway at the Ilorin airport.

A statement by the General Manager, Public Affairs, of the Nigeria Civil Aviation Authority, Mr. Fan Ndubuoke, on Saturday, said no life was lost in the incident, which he added, was already being investigated.

The statement read, “An Overland flight 1186, an ATR 72 aircraft with Registration number 5N-BPG from Abuja airport to Ilorin, carrying fifty nine passengers and four crew members,veered off the runway at low speed after a normal landing at the Ilorin Airport.

“The incident which occurred today Saturday, November 29, at 4.45pm, has no casualty recorded. However, the Accident and Prevention Bureau in conjunction with the Nigerian Civil Aviation Authority has begun an investigation into the cause of the incident.

“The authority wishes to use this medium to reassure Nigerians that safety of the traveling public is still paramount and cannot be compromised.”

A source told one of our correspondents that three professors –a former Vice Chancellor, University of Ilorin, Prof. Ishaq Oleyede, Prof. Lanre Badmus and one unnamed professor — were on board the flight.
One of the passengers, Mr. Ayuba Balami, commended the pilot for showing great experience by maneuvering the plane to safety.

However, the airline said the the plane did not crash-land at the Ilorin airport on Saturday.

A statement by the management of Overland, which confirmed the incident and insisted that there was no crash.

It said, “It was a normal flight to Ilorin and standard procedures of flight were followed. The aircraft landed safely at Ilorin Airport at 1645hrs as scheduled and decelerated to a low speed, and in turning off the active runway, veered off the pavement.

“At the directive of the Pilot In Command, our cabin crew calmly evacuated all the 59 passengers safely and they were moved to the airport terminal. No passengers or crew sustained any injuries whatsoever.

“Our Ilorin passengers have since collected their baggage and gone home while the Ibadan Airport bound passengers will continue on Overland Airways to Ibadan Airport.”

A reporter of the Channels Television in Kwara State, Mr. Akeem Garba and his crew were assaulted in Ilorin while they were covering the State Assembly primary of the Peoples Democratic Party at Ilorin West Local Government Area of the state on Saturday.

Garba and his crew had gone to Yebumot Hotel, Ilorin, venue of one of the congresses when some thugs attacked them.

Garba said that the clothe of his cameraman was torn while their camera was smashed.

Garba said, “This morning when I got to Yebmot Hotel to cover the congress, my cameraman was filming while the delegates were just going inside the venue.

About 15 thugs pounced on us and asked us: Who are you? Who sent you? All the explanations that I gave to them to know that we are from Channels TV did not yield any positive result.

“They started beating us. Even the clothe of my cameraman was torn and the camera was smashed and damaged. They were beating us right in the presence of the security operatives and they were just looking at us as if somebody’s life was not as stake.

“After the intervention of some elders of the party, we were left alone.

Again, we identified ourselves that we are from Channels TV. They pleaded with us that we should hold on that they did not know that we are from Channels TV, and we can continue filming when some of them are carrying placards to show their protest aganst certain individuals that we can then come and film.

“About 30 minutes later, as we were about filming the protest, another group of thugs, about 20 in number, pounced on us again and really smashed our camera again. We had to run to a petrol station for cover.”

There has been recurring violence in Ilorin West LGA. Our correspondent gathered that the violence affected the congress in the LGA.

There was, however, no report of violence in other venues of the congresses as of the time of filing this report.

The Kwara State PDP Chairman, Mr. Iyiola Oyedepo, condemned the attack of the journalists, wondering why journalists on their official duties would be attacked.

He said his party leadership will address their supporters on the need to avoid attacks on journalists.

The two factions of the People’s Democratic Party in Ondo State held their separate House of Assembly primaries on Saturday despite the Abuja High Court Ruling nullifying the Caretaker Committee instituted by the National Working Committee of the party.

However, in Idanre, Ondo East, Ondo West and Ese Odo council areas of the state, party members defied the line of differences and chose to hold a harmonized primaries.

The court had ruled that the caretaker committee set up by the PDP NWC should have nothing to do with issues of primaries and sustained the tenure of the current party working committee in the state.

It was gathered that INEC officials in the state stayed away from the primaries conducted by both factions due to the conflicting reports about the Friday Judgement.

Chairman of the Old PDP Ebenzer Alabi and representatives of the Mimiko-led faction, the Attorney General and Justice Commissioner Eyitayo Jegede and the State Cooperative and Community Development Commissioner, Clement Faboyede, were seen at the INEC office in Akure to complain about the failure of its staff to
witness their Primaries.

But security operatives were present at the venue of the primaries of the factions, even as the exercises were peacefully conducted across the state.

While primaries were held in some constituencies, outright ratification of consensus candidates were done in many of the areas yesterday.

Speaking with newsmen at the Party Secretariat, Alabi said the Primaries were conducted peacefully across the state.

Alabi said he and the leaders of the other faction were at the INEC office to straighten out the issue of which primaries its staff would attend.

He said that the matter was agreed in favour of the old PDP, but as of the time the Primaries was conducted and winner emerged at the Party Secretariat INEC officers were not seen.

Reports across the state showed that INEC officials did not attend any of the Primaries conducted by the two factions.

But Information Commissioner, Kayode Akinmade said INEC officials were present during the primaries held in Idanre.

CAIRO ( AP ) - An Egyptian court on Saturday dismissed murder charges against former President Hosni Mubarak in connection with the killing of hundreds of protesters in the 2011 uprising that ended his nearly three-decade rule, citing the " inadmissibility " of the case due to a technicality.

The ruling marks another major setback for the young activists who spearheaded the Arab Spring -inspired uprising nearly four years ago - many of whom are now in prison or have withdrawn from politics. It will likely reinforce the perception that Mubarak's autocratic state remains in place, albeit led by a new president, former military chief Abdel -Fattah el-Sissi.

Judge Mahmoud al -Rashidi said he dismissed the case against Mubarak because his May 2011 referral to trial by prosecutors ignored the " implicit " decision that no criminal charges be filed against him when his security chief and six of his top aides were referred to trial by the same prosecutors two months earlier.

Massive protests demanding that Mubarak be put on trial took place in April of that year.

Saturday's verdict concludes Mubarak ' s retrial along with his two sons, his security chief, Habib el -Adly, and six top security commanders, who were all acquitted . Also acquitted was wealthy businessman Hussein Salem, a longtime Mubarak friend tried in absentia.

Mubarak, 86 , was also acquitted of corruption charges that he faced along with his sons Alaa and Gamal - his one -time heir apparent - over a statute of limitations. The case involves their purchase from Salem of luxury villas in a Red Sea resort at a vastly discounted price, something that the prosecution had said amounted to bribery. The two sons face a separate trial on charges of insider trading.

All rulings can be appealed.

It was not immediately clear whether Mubarak would now walk free since he is serving a three -year jail term for corruption charges he was convicted of in May.

He has been in detention since April 2011, but it is unclear if the past 3 1/2 years will be considered as time served.

"There is no justice for the poor, " said Ramadan Ahmed , whose son Mohammed was shot dead in the Mediterranean port city of Alexandria during the uprising.

"This is Mubarak's law!"

Nearly 900 protesters were killed in the 18 -day uprising that ended when Mubarak stepped down on Feb. 11, 2011 , handing over power to the military. The trial, however, was concerned only with the killing of 239 protesters, whose names were cited in the charges.

The early days of the protests were marked by fierce street battles between the demonstrators and both police and government supporters. Vehicles plowed into crowds, and bricks and stones were hurled from the rooftops of buildings onto demonstrators gathered in Cairo's Tahrir Square . At one point , men on camels and horses galloped into the square and beat protesters with batons and whips.

Nearly 170 police officers and security officials put on trial in connection to the killings since 2011 have either been acquitted for lack of evidence or because they were found to have acted in self -defense. Some received short, suspended sentences.

Mubarak was greeted by jubilant well -wishers when he was helicoptered back from court to the Nile -side military hospital where he has been staying. A television interviewer reached him by telephone and asked whether he had ordered the killing of protesters .
" I did not do anything at all , " Mubarak replied.

Mubarak was convicted and sentenced to life in prison in 2012 on charges related to the killing of protesters, but the verdict was overturned on appeal the following year.

He has spent virtually all the time since he was detained in hospitals due to poor health. On Saturday, he was brought to the defendants ' cage on a gurney. He wore dark glasses , a navy blue tie and a matching cardigan.

Al-Rashidi , the judge , said the dismissal of the charges did not absolve Mubarak of the corruption and " feebleness" of the latter years of his 29 -year rule and praised the 2011 uprising , saying that its goals - freedom, bread and social justice - were legitimate.

Al-Rashidi said Mubarak , like any other human , erred at times and suggested that his old age should have spared him a criminal trial . He also cited Mubarak's long years in public service and what he called the enshrinement of "constitutional legitimacy" following the ouster of Mubarak's successor, the Islamist Mohammed Morsi.

Mubarak was a career military pilot who led the air force during Egypt's last war against Israel in 1973 . He was made vice president in the mid-1970 s and assumed the highest office in 1981 following the assassination of Anwar Sadat.

"To rule for or against him after he has become old will be left to history and the Judge of Judges, ... ( God), who will question him about his rule, " the judge said.

The reaction to the verdicts was muted, after the judge threatened to jail anyone attending Saturday's 45-minute hearing if they interrupted the proceedings. After the trial was adjourned the courtroom broke into cheers and applause. Dozens of protesters briefly gathered just north of Tahrir Square, closed off by soldiers, chanting against el-Sissi.

Morsi, the Islamist who succeeded Mubarak, is detained and faces a slew of charges, including some related to the killing of protesters, which could see him sentenced to death. He was elected in Egypt's first democratic presidential election in 2012, but was overthrown by el-Sissi a year later amid massive protests calling for his resignation.

Since then the government has launched a sweeping crackdown on Morsi's Muslim Brotherhood group and other supporters, killing hundreds and jailing thousands. It has also jailed scores of secular activists , including some of the leaders of the 2011 uprising, for violating a draconian law regulating street protests that was adopted a year ago.

The Independent National Electoral Commission on Friday failed to distribute Permanent Voter Cards at the Ward G3, State Junior Secondary School, the polling unit where the State Governor, Mr. Babatunde Fashola, and his wife, Abimbola, registered.

It was learnt that some INEC ad-hoc staff had earlier pasted a notice to notify voters who had registered in the two wards on Itolo Street that they had no PVC.

The commission said the voters would have to register afresh at a later date.

The notice pasted at the entrance of the school read, “We regret to inform you that those who registered in this polling unit do not have Permanent Voter Cards.

Please come back between 3rd and 8th of December 2014 for fresh registration.”

Lagos State Resident Electoral Commissioner, Dr. Adekunle Ogunmola, attributed the development to loss of data arising from the crash of their computing system.

“Yes, some of the data captured during the registration in 2010 crashed. This was the reason we lost about 1.4 million data for voters. We are embarking on fresh registration for them and others who were unable to register in the 2010 registration.”

Fashola had yet to react to the development.

There was unrest on the campus of Obafemi Awolowo University, Osun State, southwest Nigeria, on Friday, 28 November, 2014 as students of the institution hauled stones and sticks at President Goodluck Jonathan during his visit to the campus.

President Jonathan, notable traditional rulers in the southwest and politicians had attended the Yoruba Unity Summit organised by the Committee on Yoruba Progress, southwest geo-political zone of the country where the president was endorsed for his re-election in the 2015 general election.

But the placard-wielding students of the institution who had converged at the Oduduwa Hall, venue of the conference to protest what they termed “rot in the educational sector” booed and stoned President Jonathan while entering the presidential chopper few minutes after the summit.

The irate protesters were shouting “ole” “ole” (“thief”, “thief”) at the president and other notable politicians who attended the event.

They displayed placards with inscriptions like: “We Condemn Jos Killing of Students, Students Are Not Chicken”, Don’t Sell Education As You Sold Electricity.”, We Demand Total Reversal of 2014 Hiked School Fees, We are Not Responsible For Jonathan’s Ineptitude.” among other inscriptions.

The students who were in their hundreds barricaded the road leading to the school’s sports centre where the chopper wearing the seal of the Federal Government and marked Nigerian Air Force, NAF-280, requesting that President Jonathan should address them before departing the campus.

In the ensuing unrest, the convoy of President Jonathan was delayed for few minutes as the students refused the President and his entourage passage to board the chopper despite pleadings by some security operatives.

Also, the Governor of Ekiti state, Mr. Ayodele Fayose who attempted to pacify the angry students was booed as students chorused ‘thief on him.

The vehicle conveying the Ooni of Ife, Oba Okunade Sijuade was not spared as students sat at the front of his vehicle for minutes before he was eventually allowed passage.

While the President was boarding the chopper, some students continue to aim pebbles at the chopper before they were dispersed by security operatives.

although none of the thrown missiles touched the president.
Some students who had examinations also expressed their displeasure at the condition they were subjected to owing to President Jonathan’s visit to the campus.

Most of the students had to walk long distance to their examinations’ venues as there was no vehicular movement on campus and its environs.

Meanwhile, a segment of the Yoruba people at the conference endorsed President Jonathan for a second term of office even as they urged him to help recover their political and social values.

Appeal Court Orders NICON Group To Pay N1.7b Debt To Ekobank


The Lagos Division of the Court of Appeal yesterday dismissed an appeal filed by NICON Group of Companies Plc challenging a judgment delivered by Justice Chukwujekwu Aneke of the Federal High Court, which ordered it to pay Ekobank Plc N1.7billion.

The appellate court presided over by Justice Jamilu Yammama Tukur in an unanimous judgment held that NICON could not complain that its rights to fair hearing were breached because its counsel was present when Ekobank’s lawyer, Kunle Ogunba (SAN) argued the application at the lower court.

NICON, as part of its grounds for filing the appeal, argued that it raised a preliminary objection to the admissibility of certain unmarked and uncertified documents relied on by Ekobank, and that Justice Chukwujekwu Aneke had adjourned for ruling.

The court also argued that “It was the preliminary objection of the appellant that was argued and adjourned for ruling at the lower court and not the substantive suit.

"But, to the utter bewilderment of the appellant, on 5th of May 2014, the lower court, instead of delivering a ruling on the preliminary objection raised by the appellant, went ahead and gave judgment to the respondent as per its writ of summons, when the substantive suit was neither argued by parties nor heard by the court.”

Based on this argument, the appellant urged the Appeal Court to determine “whether entering summary judgment in favour of the respondent by the trial court in its ruling in respect of the preliminary objection filed by the appellant, without allowing the appellant to defend the suit on the merit does not amount to a gross violation of the appellant’s right to fair hearing.”

NICON also asked the appellate court to allow the appeal and set aside the decision of the lower court. 

But the appeal court resolved all the issues in favour of the respondent holding that “It naturally follows that the appeal should be and is hereby dismissed for lacking in merit.”

Two other justices – Rita Pemu and Chinwe Iyizoba – concurred. Justice Pemu said NICON neglected to deliver a written notice of defence and affidavit within the stipulated time by the rules of court.

“In the instant case, the appellant filed no written notice of defence and affidavit within the time stipulated by the rules of court, neither did he file any affidavit disclosing a defence, satisfactorily explaining his defence, to enable the lower court let him defend the suit. The lower court was therefore right in the circumstance to enter judgment.

“The ruling of Hon. Justice C.J. Aneke delivered on the 5th day of May 2014 in Suit No. FHC/L/CS/91/2014 is hereby affirmed. The appeal is dismissed by me and I abide by the consequential order made in the lead judgment including the order as to costs,” Justice Pemu held.

In the same vain, Justice Iyizoba held that,  “The learned trial judge rightly entered judgment for the respondent on the basis that there was no defence to the suit. I agree that the appeal lacks merit. I also dismiss it and abide by the consequential orders in the lead judgment.”

It will be recalled that, Justice Aneke, in the judgment, also ordered NICON to pay interest on the "cumulative indebtedness totalling N1,787,108,417.92" at the rate of 30 per cent per annum from November 28l, 2013 to judgment day.

It ordered that the interest rate on the cumulative debt shall be 10 per cent per annum after judgment until the debt was fully paid.

Justice Aneke also awarded N100,000 to the bank as cost incurred in the litigation. 

He ordered NICON to pay "the sum of N1,599,597,144.04 being the mutually agreed and subsisting indebtedness of the defendant to the plaintiff as per plaintiff's correspondence of April 5, 2012endorsed and covenanted to by Barrister Jimoh Ibrahim, the defendant's Chairman, prime mover, alter ego.

He also entered "judgment in the sum of N187,511,273.91 being the accrued interest thereon on the mutually agreed sum from April 30, 2013 till November 27, 2013 at the rate of 20 per cent per annum; interest on the cumulative indebtedness totalling N1,787,108,417.92 at the rate of 30 per cent per annum from November 28, 2013 till judgment (or sooner payment) and thereafter at the rate of 10 per cent per annum until the final liquidation of the judgment sum; cost of the sum of N100,000 in in favour of the plaintiff."

Ecobank had offered loan to NICON through a letter dated June 21, 2006. It had asked the court to dismiss NICON's preliminary objection to the suit which it instituted under Undefended List Procedure.

NICON's counsel, Chief Niyi Akintola (SAN), through his preliminary objection, contended that the court lacked jurisdiction to entertain the suit.

One of Akintola's grounds of objection was that the claimant had filled the request agreement with respect to recourse to arbitration as stated in the offering agreement dated June 21, 2006.

Akintola also maintained that the court lacked jurisdiction because the subject matter of the suit did not fall within the exclusive jurisdiction of the court.

The Economic and Financial Crimes Commission (EFCC) on Friday

secured the conviction of Joseph Friday Idachaba, a top prison
officer, spokesman Wilson Uwujaren, said on Friday.

Justice JJ Majebi of the Kogi state high court, Okene, convicted and
sentenced Idachaba, deputy comptroller of prisons, to seven years
imprisonment for offences bordering on obtaining money by false
pretence.

According to Uwujaren, the convict is to pay the sum of N1,
403,114.09 in restitution to Nigeria Prison Service.
Arraigned in 2012 on a three-count charge, the convict was found
guilty on Count 3 of the charge by the trial judge, who, however,
acquitted him on two remaining counts.

Count three of the charge reads: ‘That you Joseph Friday Idachaba,
being a deputy comptroller of Nigeria Prison Service, and Onoja D
Ruth (IP) also a staff member of Nigeria Prison Service, sometime
between July 2012 and February 2013 at Lokoja, Kogi state did, with
intent to defraud, obtain N1,403,114.09 only from the federal
government of Nigeria via the Nigeria Prison Service with pretence
that same amount was the payment of monthly salaries from Nigeria
Prison Service, which amount was credited into the UBA Plc account
No 2054047736 belonging to one Opia Mohammed Ugbade (now at
large), through NIGSS electronic fund transfer (NEFT) between July
2012-to February 2013, that the said Opia Mohammed Ugbade’s name
found in the Nigeria Prison Service electronic payroll is not a staff
member of the service which pretence you knew to be false and
hereby committed an offence contrary to section 1(1) paragraphs
A&B and punishable under section 1(3) of the Advance Free Fraud
and Other Related Offences Act.”

The State Security Services (SSS) yesterday failed to produce in court five employees of the data office of the All Progressives Congress (APC) arrested by the security agency on December 22, 2014, as ordered by Justice Mohammed Yunusa of the Federal High Court in Lagos.

Justice Yunusa had on Wednesday ordered the SSS to produce the five employees, who were arrested by operatives of the service and the police during a raid on the data office on Saturday, in court on friday.

The security agency was also mandated by the court to come and explain why the employees are still being held in custody beyond the constitutional allowed period.

Those in detention include: Chinedu Atuche, Fayemi Olaposi,  Augustine Onuchukwu, Ebun Ilori, and Esther Enemy.

But when the case was called for hearing yesterday, the counsel, who represented the SSS in court, Peter Okerinmodun, told the court that the agency is not aware of the court's order.

The lawyers claim is, however, contrary to the proof of service in the court file, which showed that his employer has been served with a copy of the court's order at their Abuja office .

When the judge asked him why he was in court since he had not been served, Okerinmodun said that, "My appearance today is based on what I read in newspapers.

"I made contact with (SSS) headquarters to ascertain the authenticity of the reports and they told me there was no service on them. Even as at this morning, nobody has confirmed Service, so I only come to court out of respect as I have not been briefed," he said

However, counsel to the APC, Prof. Yemi Osibajo (SAN), informed the court that both the police and the SSS were duly served, only that the latter refused to accept service at their Lagos office.

"The first respondent (the Nigerian police) were served here (Lagos) and in Abuja. We also served the second respondent (SSS), in pursuant to the orders of this court in Abuja and they accepted service.

"The proof of service is in the court's file and the SSS ought to have obedyed the orders of my lord, to produce the five applicants," Osibajo submitted.

While asking for a short adjourment, Okerinmodun said "We are never known for disobeying my lord's orders, so I need time to sort out the confusion by getting across to Abuja to find out if they have accepted service".

To this, Osibajo expressed reservations at the SSS counsel's claims, noting that the judge's orders were unambiguous.

"We are just worried that these individuals have been in detention since Saturday," he said.

In a short ruling Justice Yunusa said he believed Okerinmodun because he "had been a good lawyer in my court" and based on that he would adjourned till December 1 to enable the respondent to comply with the orders.

It will be recalled that the judge had also restraining the SSS from further sealing off the data office of the  APC or taking further steps in connection with the property.

The judge made the interim orders while ruling on a fundamental rights enforcement suit filed by the APC.

According to the party a combined team of the State Security Service operatives and naval police officers raided the data centre of the All APC in Ikeja, Lagos, in the early hours of Saturday.

The operatives ransacked the centre and carted away the servers, routers, hard drives from personal computers and the work stations.
The 24 staff on the night shift and another one from her residence were arrested.

But the Department of State Security (DSS) denied the allegation, stating instead that it raided the premises following a petition it received about some activities of the company.

A text message by the spokesperson of the DSS, Ms. Marilyn Ogar on Sunday, said the petition alleged that the Independent National Electoral Commission’s permanent voter’s cards were being cloned at the outfit.

According to Ogar, the petition alleged that the “cloning” of the cards was with the intention of hacking into INEC’s data base, corrupting it and replacing them with the “cloned” data.

The Speaker of Kebbi State House of Assembly, Hon. Habib Musa Jega has been impeached.

Hon. Mohammed Shalla Gwandu has been sworn-in by the clerk of the House, Shehu Usman Randali, as the new Speaker.

The impeachment, which took place around 10:25pm at the House of Assembly in Birnin Kebbi was signed by 16 members out of 24 members of the House.

Shortly after the swearing of the new speaker, Hon Mohammed Shalla Gwandu thanked the House for the trust they had in him and promised to work harmoniously with all members and the state government.

“I thank all the members for the confidence they have in me and promise to wok harmoniously with both the state government and members of the House so that our people will reap dividends of democracy,” he said.

Hon Abdullahi Garba Fana representing Dandi constituency told news men that the House sat and reviewed the performance of the former leader and concluded that the impeached speaker was incompetent to continue as their leader.

When asked to mention the impeachable offences committed by the ex-speaker, he said “The reason is just incompetence and members have no confidence in him any longer.”

The impeachment is coming barely two days after the news of 17 members of House allegedly planning to dump the Peoples Democratic Party (PDP) for the All Progressives Congress (APC).

The Economic and Financial Crimes Commission, EFCC on Thursday arraigned the Chairman of Kauru Local Government Area, Kaduna State, Usman Shehu Ibrahim, his deputy, Paul Yerima and Timothy Chindo, Chairman of the Peoples Democratic Party, PDP, in the Council, before Justice Tukur Mu’azu of the State High Court on
a three count charge of Conspiracy and criminal breach of trust.

The accused persons are alleged to have in February, 2013 conspired to fraudulently misappropriate the council’s share of Subsidy Re-investment and Empowerment Programme (SURE-P) funds amounting to N68, 000,000.00 (sixty-eight million naira) which was meant for the renovation of primary healthcare centres, primary schools, construction of boreholes and purchase of poverty alleviation materials across the eleven wards of the council.

Count three of the charge reads, “that you Alhaji Usman Shehu, Timothy Chindo and Paul Yerima, sometime between January 2012 to January, 2013 at Kaduna within the jurisdiction of the High Court, being entrusted with dominion over property to wit: N 68,000,000.00 (sixty eight million naira) belonging to Kauru Local Government, did commit Criminal Breach of the said property and thereby

Court Refuses To Stop Obanikoro From Contesting PDP Governorship Primary

A Lagos State High Court sitting in Ikeja yesterday  declined to restrain a former Minister of Defence, Senator Musiliu Obanikoro, from contesting in the forthcoming governorship primary of the Peoples Democratic Party (PDP) slated for December 8.

The trial judge, Justice Kazeem Alogba instead asked the applicants to put Obanikoro on notice because they failed to convince him of the urgency of the suit to warrant granting the order.

The judge told the applicants that they should have brough the ex parte application along with the originating summons earlier filed on the subject matter on November 14, if there was urgency as was argued by their counsel, Wahab Shittu.

Three members of the party in Lagos have gone before the court urging it to bar former Minister from participating in the party’s forthcoming primaries.

The members, Micheal Babatunde Ogun, Suleiman Olayinka Saheed  and Wasiu Adeniyi Odusan, based their request to the court on the ground that he had allegedly presented a forged documents to the Independent National Electoral Commission (INEC).

In an originating summons filed before the court by the three members, they are praying the court to declare that based on the provision of Paragraph 4 (a) of Part iv of the Electoral Guidelines for primary Elections, 2014, of the INEC, Obanikoro was not eligible to participate in the gubernatorial primary election of the PDP scheduled for December 8, 2014 in Lagos State.

Joined in the suit are the Independent National Electoral Commission and the Peoples Democratic Party, PDP.

While moving the ex parte application on the subject matter, Shittu, submitted that it was expedient to stop Obanikoro in order not to allow for illegality.

"A democracy is principally founded on the rule of law. At all times there are two choices to make, whether you want to be guided by the rule of law or by the culture of impunity. Your Lordship will decide this issue for history and for posterity," Shittu said.

However, the judge in his ruling, said that considering the gravity of the allegations levelled against Obanikoro, it would only be fair to grant him fair hearing before making any such order.

The judge held that it did not believe that the interest of the applicants would be jeapardised in anyway if the court did not make an instant order  restraining Obanikoro from participating in the said primary.

Justice Alogba therefore asked the applicants to serve the respondents with the relevant  processes, including the option of substituted service through either The Punch or The Guardian Newspapers.

The court subsequently adjourned till December 9, a day after the PDP primary, to hear the substantive suit.

The applicants were praying the court to declare that by the provision of Paragraph 4 (a) of Part iv of the Electoral Guidelines for primary Elections, 2014, of the INEC, Obanikoro was not eligible to participate in the gubernatorial primary election of the PDP scheduled for December 8, 2014 in Lagos State.

They also argued that in view of the alleged  age falsification, Obanikoro was not even eligible to contest on the platform of any political party in Nigeria.

They said, "Pursuant to Sections 182(1) (a) (j)  of the 1999 constitution, Sections 31(2), 31 (5) 31 (6) and 31 (8) of the Electoral Act, 2010 and Section 10 (1)  and other relevant sections of the PDP constitution, the 1st respondent stands disqualified by virtue of his antecedents and constitutional provisions."

Justice Lateef Lawal-Akapo of the Lagos High Court sitting in Ikeja will on January 19, 2015 decide whether or not to quash the N4.7 billion fraud charge filed against the Chairman of Bi-courtney Limited, Wale Babalakin (SAN) and four other.

Justice Lawal-Akapo fixed the date on Thursday after both the prosecution and defence lawyers concluded their argued on an application filed by Babalakin and his companies, challenging the jurisdiction of the court and the competency of the charge against them.

Babalakin (SAN), Stabilini Vision Limited, Bi-Courtney Limited, Alex Okoh, and his company Renix Nigeria Limited are standing trial before justice Lawal-Akapo on an alleged N4.7 billion fraud brought against them by the commission .

The EFCC alleged that Babalakin and his co-defendants fraudulently assisted convicted former Delta State Governor, James Ibori to transfer huge sums of money through various parties to Erin Aviation account in Mauritius for the purchase of a plane.

The 27 count charge borders on conspiracy, retention of proceeds of criminal conduct and corruptly conferring benefit on account of public action. 

But the defendants through their lawyers, instituted separate applications, praying the court to quash the N4.7bn charges, with a position that the EFCC, as a federal agency, lacked valid fiat to prosecute them in a state high court.

The defendants through their counsel, Dr. Biodun Layonu (SAN), Tayo Oyetibo (SAN), Roland Otaru (SAN), Dr. Joseph Nwobike (SAN) and Oladapo Adeosun had also argued that the state High Court has no jurisdiction to hear offences brought under the EFCC Act.

The lawyers further submitted that all the charges against the defendant were predicated on repealed laws of Lagos State and urged the court to quash the charges.

They also submittd that the defendants were not properly informed of the details they were charged for as stated in the Constitution, adding that count 2 to 13 of the charge did not inform the defendant the details of the offence, neither did they constitute an offence under any written law in the country.

But counsel to the anti-graft agency, Rotimi Jacobs (SAN) urged the court to dismiss the application, arguing that the power of the commission to prosecute is backed by the constitution.

The lawyer also submitted  that it is trite law that the schedule to the Constitution is part of the Constitution; it has the same force, it has the same competence and same strength as the Constitution itself."

Jacobs further argued that Ibori, in the capacity of a governor was a public officer. He said that though the Constitution did not capture a governor as a public officer, the schedule to the Constitution did.

He submitted that the schedule was as competent as the Constitution and that the charges were sustainable.

The lawyer stated, "I agree with my learned friend, Wale Akoni (SAN) that a public officer is not defined within the Constitution from Sections 1 to 318; but the definition is in the Constitution; the word public official is defined in the schedule to the Constitution in Article 19 part one of the 5th schedule. Indeed, item four of part two of the 5th schedule mentioned the governor of a state as a public officer.

A Peoples Democratic Party (PDP) chieftain in Lagos, Nurudeen Balogun has urged a Lagos State High Court sitting in Ikeja to stop one of the gubernatorial aspirant of the party, Jimi Agbaje from contesting the forthcoming Governorship primary of the party fixed for December 8.

Balogun, who claimed to be interested in becoming the governorship candidate of the party, is insisting that Agbaje is not eligible and qualified to run for any elective position in the forthcoming primaries having only joined the party in July 2015.

Apart from Agbaje, also joined in the suit are the PDP and the Independent National Electoral Commission (INEC).

Balogun, in an affidavit attached to the suit and filed on his behalf by his counsel, Clement Onwuenwunor, claimed that in accordance with Section 50(9) of the PDP’s Constitution, only aspirants with minimum of two years membership span are eligible to stand for election into any public office under it platform .    

The politician also averred that as at today, the "26th day of November, 2014" the 1st Defendant (Agbaje) is barely 4 months old as a legitimate card carrying member of the 2nd Defendant (PDP).

Balogun also maintained that the 1st Defendant who has never paid his registration dues and regular annual subscription fees for renewal of his membership is not eligible to contest elective position to a public office on the platform of the 2nd    Defendant.

He further claimed that, "I am aware that the 1st Defendant has not been given any waiver by the National Working Committee (NWC) of the 2nd Defendant as stipulated by the 2nd Defendant’s Constitution to contest for elective position to the office of the Governor of Lagos State under the platform of the 2nd Defendant.

"That on 21st November, 2014 I petitioned the Chairman, of the South-West Governorship Screening Committee of the 2nd Defendant of this unwholesome practice and blatant infraction of the 2nd Defendant’s Constitution by the 1st Defendant and his cohorts in the 2nd Defendant’s Political Party.

"Notwithstanding the said petition, the 2nd Defendant did not respond, reply or take necessary appropriate action on the said petition and that it is sequel to the above averment that this suit became necessary to forestall radical violence to the 2nd defendant's Constitution by the 1st Defendant," Balogun averred.  

He therefore praying the court for an Injunction restraining the 1st Defendant from parading himself as candidate for election or presenting himself to any organ of the 2nd Defendant, especially the Screening Committee, for the purpose of being screened for the primary election for 2015 Governorship election in Lagos State having only joined the 2nd Defendant in July 2015 and his membership not regularized.

He also wants the court to grant him an Injunction restraining the 2nd and 3rd Defendants (INEC), their agents, servants and or privies from accepting Expression of Interest/Nomination Forms from the 1st Defendant or screening him to participate in the primary election for 2015 Governorship election in Lagos State having only joined the 2nd Defendant in July 2014 and his membership not regularized.

The politician is equally wants the court to declare that it is only a duly registered member of the 2nd  Defendant or one whose membership is regularized, can present himself and pick Expression of Interest/Nomination Forms for the purpose of the primary election for 2015 Governorship election in Lagos State.

Balogun is further playing the court for a declaration that the 2nd  and 3rd  Defendants are not entitled to accept Expression of Interest/Nomination Forms from the 1st  Defendant for the purpose of participating in the primary.

No date has been fixed for hearing of the suit as it is yet to be assigned to a judge

A Federal Capital Territory High Court in Kubwa, on Tuesday rejected a plane letterhead of the office of President Goodluck Jonathan tendered by the Federal Government in the forgery suit instituted against two journalists with the Leadership newspaper.

The Leadership Group Limited, its Group News Editor, Mr. Tony Amokeodo, and amsenior correspondent with the newspaper, Chibuzor Ukaibe, are facing 11 counts of forgery and conspiracy following the publication of the bromide of a presidential directive by the newspaper on April 3, 2013.

At the resumed hearing of the case on Wednesday, the prosecuting counsel, Chief Adegboyega Awomolo (SAN), sought to tender the plane letterhead in his bid to prove the forgery allegation against the accused.

But Justice Usman Musale rejected the document, upholding the contention of the defence counsel, Mr. Femi Falana (SAN), who had argued that the exhibit was not admissible since it was certified by the Office of the Chief of Staff to the President instead of the office of the President itself.

Falana said, “What they sought to tender is a blank sheet of paper from the Office of the Chief of Staff to the President. Since the witness has said that he got a certified true copy from the Office of the Chief of Staff, he cannot tender it.

“He cannot seek to tender a letterhead paper from the Office of the Chief of Staff because there is dichotomy between the President and the Chief of Staff. The document in dispute is from the Office of the President and not from the office of the Chief of Staff. I urge the court to reject it in the interest of justice.”

Awomolo had sought to tender the document through a prosecution witness in the case, Mr. Ibrahim Bako, a police officer.

Bako had testified that the police received complaint about the case and that in the course of the investigation he went to the Presidency and met an assistant director, Abiye White, who gave him a blank letterhead paper from the office of the President.

He concluded that the published letter could not have emanated from the Presidency.

Bako added that the investigation revealed that the bromide and the Coat of Arms in the publication did not tally with the document he obtained from the Presidency.

At that point, Awomolo sought to tender a certified true copy of the letterhead paper which the witness said was obtained from the office of the President.

In response to Falana’s objection, Awomolo said it was misconceived.
He further argued that the document was from the officer who had custody of it.

“It is wrong to expect that the President will certify documents by himself,” Awomolo said.

But Justice Musale in his ruling rejected the document, saying that it could not be admitted as exhibit against the accused person.

The case has been adjourned to January 21, 2014.
