Ogun PDP Crisis: Court Affirmed Adebayo Dayo Led Exco 

Justice Mohammed Idris of the Federal High Court in Lagos on Friday affirmed that the Adebayo Dayo led executive committee of the Peoples Democratic Party (PDP) in Ogun State is the authentic leadership of the party in the state.

Justice Idris, who stated this while delivering judgment in a case filed by some chieftains of the PDP in Ogun State, held that the plaintiff are beneficiaries of the judgement of Justice Ibrahim Buba in the suit no FHC/L/CS/636/2016 which affirmed that the tenure of the Adebayo Dayo led executive of PDP in ogun state substist until May 2020. 

The court, therefore, directed the Independent National Electoral Commission (INEC) and the PDP who were sued as first and second defendants in the suit to obey the judgement of Justice Ibrahim Buba delivered on the 24th of June, 2016. 

The court also nullified the Congresses which were held in deviance of Justice Buba's judgement, which produced the Hon. Sikirulai Ogundele-led Ogun State PDP executive.

The judge held, "The decision of a court of competent jurisdiction is binding on on all parties concerned until set aside by either the Court of Appeal or the same court that made the order, if found to be made in error. 

"I not not in agreement that the decision by my learnt brother Justice Buba is in conflict with the decision of the learnt law lords of the Supreme Court.

"All objections are overruled, parties are bound by the judgement of this court delivered by Buba J. and everybody should obey the judgement of court until set aside," he insisted.

The court equally nullifies the appointment of Odanye and others as Ogun State PDP Caretaker Committee, saying their appointment was contrary to a judgment delivered by the court on June 24, 2016, which affirmed Adebayo Dayo led executive.

The suit was filed by some member of the PDP, including a member of the National Working Committee, Alhaji Adewole Adeyanju, Ogun State Youth Leader, Femi Alao, the “national delegates” for Sagamu and Ijebu North Local Government Areas, Idris Muniru.

Others were: Chief Tuke Omotara, Chairman of Ijebu East LGA, Badejo Abiodun and the Chairman of Sagamu LGA Kola Akinyemi.

They sued for themselves and on behalf of “PDP Ogun State Delegates to the National Convention”.

The defendants include the Independent National Electoral Commission (INEC), PDP, the party’s National Caretaker Committee, Senator Ahmed Makarfi, Senator Ben Obi, Tunde Odanye, and 25 others.

According to them, there were subsisting and binding judgment and orders of the Federal High Court in Lagos delivered by Justice Ibrahim Buba on June 24, 2016 and on August 10.

They urged the court to restrain the PDP Caretaker Committee in Ogun State from usurping the plaintiffs' functions as “authentic officers of the Ogun PDP Executive Committee” led by Chief Adebayo Dayo.

They also asked the court to nullify the appointment of Odanye and others as Ogun State PDP Caretaker Committee, saying their appointment was contrary to a judgment delivered by the court on June 24, 2016.

They said the judgment recognises the Adebayo Dayo-led executive committee as the authentic one.

The  plaintiffs’ counsel Ifoma Ezom thanks the court for the industry imported to deliver the judgement.
